Eligibility: An entrant must be a legal resident of the United States, 18 years of age, and reside in the continental United States, at the time of entry. If entrant is under 18, he or she must provide their parent or legal guardian's physical or e-mail address. We will notify the parent or legal guardian if the child wins a prize and will send a parental permission form. Employees, officers, and directors (and their immediate family members and persons living in their same household) of Surf School, LLC or Bluewater Production, LLC, its affiliated companies, and its advertising and promotion agencies, are not eligible to participate in the Sweepstakes. Void outside of the continental United States, in Puerto Rico and where prohibited by law.
Entry: No purchase is necessary to enter the Sweepstakes. There is only one way to enter the Sweepstakes. Your e-mail entry must be received between 12:01 a.m. (PT) on 3/11/06 and 11:59 p.m. (PT) on 8/11/06. You must submit a valid email address. Only one entry per person (or group, if applicable) is permitted. Sponsor is not responsible for, and will have the right to refuse in its sole and absolute discretion, lost, late, damaged, incomplete, illegible, or misdirected entries. Sponsor will not notify entrants whether or not their entry has been rejected or accepted. All entries become Sponsor's property and will not be returned. Odds of winning depend on the number of eligible entries received. If entrant wins and is under the age of 18, parents will be contacted to get permission to accept the prize and obtain delivery of prize information. No postal address is required to enter contest. This information is only required from winners for delivery of prize.
Sweepstakes Period: The Sweepstakes submission period begins on March 11, 2006 at 12:01 a.m. Pacific Time and ends on August 11, 2006 at 11:59 p.m. Pacific Time (the "Sweepstakes Period"). Sponsor's calendar and clock is the official time keeping device for the Sweepstakes. No entries into the Sweepstakes will be accepted before or after those dates unless Sponsor elects in its sole discretion to modify the Sweepstakes Period. Winners shall be chosen in a drawing on August 12, 2006 in Los Angeles, California.
Prize: First prize (1): Trip for 2 to Los Angeles, including airfare and hotel, and
two surf lessons from Surf School star and ex-pro surfer Cam Powell. Value-$1,250. Second Prize (2): Collectors item hand-painted 6-foot surfboards used in the film. Value-$1,000. Third Prize (20): Ezekiel surf shorts. Value-$750
Fourth Prize (200): Very cool Surf School T-shirts. Value-$1,000. Winner is responsible for all meals, tips, and any and all applicable taxes, insurance, ground transportation, parking, and all other expenses not specified above as included in the prize. To the extent applicable, actual prize value will vary depending on travel and accommodation arrangements, and may be higher taking into account intangible benefits. No alternative prize, cash or other substitution is permitted except in the sole discretion of Sponsor in the event of prize unavailability, in which case a prize of equal or greater value will be provided. Prizes are non-transferable and may not be sold or otherwise exploited for any commercial purpose. Any prize won by a minor may in Sponsor's discretion be awarded to his or her parent or legal guardian, who must sign any documentation required by Sponsor. If a prize includes travel, a minor must travel with a parent or legal guardian, at such parent or legal guardian's own expense if the prize does not include a companion transportation ticket. You agree that Sponsor shall not be responsible for injuries or losses of any kind resulting from acceptance or use of the prize.
Selection of Winner: One winner will be randomly selected from all eligible entries received during the Sweepstakes Period. Odds of winning will depend on the number of eligible entries received. Sponsor will announce the winner of the Sweepstakes on or about June 30, 2006 via telephone or e-mail. There will be only one (1) winner of the first prize(s), two (2) winner(s) of the second prize(s), twenty (20) winner(s) of the third prize(s) and two hundred (200) fourth prize winner(s). Winner(s) will be notified by phone or e-mail. If a prize notification is returned as undeliverable or the winner(s) otherwise cannot be readily contacted, the prize will be forfeited and will be awarded to the runner-up if feasible, and if not feasible to another eligible entrant as determined and selected by Sponsor in its sole discretion. As a condition to receiving the prize(s), the winner(s) will be required to sign and return to Sponsor within ten (10) business days an affidavit of eligibility, liability release, and publicity release, along with such other documentation as Sponsor may require in its sole discretion. If the winner(s) does not return such documentation within the required timeframe, Sponsor may select another winner. Publicity: Nothing contained herein or in any of the Sweepstakes related materials should be construed as an endorsement by Sponsor or any other third party, product, or service. Except where prohibited by law, participation in the Sweepstakes constitutes each entrant's and winner's consent to Sponsor's and its respective parents, subsidiaries and affiliates use of such person's name, biography, likeness, voice, photographs, video, opinions, hometown, state and country for promotional purposes in any manner or media (including, without limitation, online), worldwide, in perpetuity, and without further payment, consideration or consent.
Data Collection: Personal information is collected from entrants when they enter the Sweepstakes. When entering the Sweepstakes, you may be asked to consent to receive promotional emails and information about Sponsor, or to be otherwise contacted by Sponsor. When entering by mail, you may indicate your desire to "opt out" of such communications on your entry postcard. These consents are optional, and are not necessary to enter or win this Sweepstakes, nor will it increase or improve your chances of winning.
Release and Limitations of Liability: By entering this Sweepstakes, each entrant forever and irrevocably agrees to release and hold harmless Sponsor, its parents, subsidiaries, affiliates, sweepstakes partners and prize suppliers (including, without limitation, Administrator), and all of their respective officers, directors, employees, owners and agents (the "Released Parties") from and against any claim, cause of action, damages or liabilities arising out, directly or indirectly, in whole or in part, from entrant's participation in the Sweepstakes or Sweepstakes activities, or the award, receipt or use of any prize, including, but not limited to: (i) unauthorized human intervention in the Sweepstakes; (ii) printing errors; (iii) errors in the administration of the Sweepstakes or the processing of entries; or (iv) injury or damage to persons or property (including, without limitation bodily injury or death) which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Sweepstakes or Sweepstakes' activities, or the award, receipt or use of any prize. Each entrant further agrees that in any cause of action, the Released Parties' liability will be limited to actual out-of-pocket costs incurred in entering and participating in this Sweepstakes, but in no event attorneys' fees. Each entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, incidental, consequential, direct, or indirect damages.
General Conditions: Sponsor is not responsible for and shall not be liable for: (i) misdirected or delayed mail or e-mail; (ii) telephone, telecommunications, hardware or third party software malfunctions, failures, or difficulties of any kind; (iii) any condition caused by events beyond Sponsor's control that may cause the Sweepstakes to be disrupted, corrupted or terminated; or (iv) any printing or typographical errors in any materials associated with the Sweepstakes. Sponsor reserves the right to disqualify, in its sole discretion, any person tampering with the entry process, the operation of the systems required to conduct the Sweepstakes or, who is otherwise in violation of these Official Rules. All issues concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the participants, shall be determined by Sponsor in its sole discretion and governed by California law. Entrants submit to the exclusive jurisdiction of the state and federal courts located in Los Angeles, California. Sponsor does not make any representation, warranty or guarantee, express or implied, relating to the Sweepstakes. You hereby agree to indemnify and hold harmless Sponsor and its affiliates, employees, officers, directors, and agents from any claim, liability, injury, damage or other loss arising out of or related to your participation in the Sweepstakes, including without limitation any Material submitted, any failure on your part to fully comply with these Official Rules, and any acceptance and use of any prize.
